Local Law 99 of 2005 contained the new Plumbing Code for New York City and certain administrative portions of the new construction codes. It called for submission of a completion bill prior to July 1, 2007. The bill containing the remaining four codes and necessary revisions to the administrative provisions is the completion bill. When passed, the complete body of the new codes is scheduled to become effective July 1, 2008.

The Building Code - which sets forth regulations for construction - is one of four codes in the new NYC Construction Codes. Other codes that have been revised as part of the Model Code Program are the Fuel Gas, Mechanical, and Plumbing Codes.

The new NYC Construction Codes enhance safety while providing opportunities for cost savings, efficiency, and sustainable building. Putting safety front and center, the new Codes preserve the best of the current code and enhance requirements for fire protection, construction safety, and structural integrity requirements for new buildings.

A consensus-building model was used to develop the new construction codes for New York City. Thirteen technical committees established by the Department of Buildings' Model Code Program reviewed the International Codes (I-Codes) and the current New York City Building Code line-by-line, incorporating referenced standards from the National Fire Protection Agency (NFPA) and other national organizations and modifying the I-Codes for New York's unique, dense, and urban environment.

The new codes apply to new buildings and construction, although select provisions, including those regarding enforcement and construction safety, will apply to all work performed following the effective date of the new codes.

The New NYC Construction Codes may be viewed in their local law format via the Department's website at: www.nyc.gov/buildings. Click on the "NYC Construction Codes" button the navigation bar on the left side of the page. The International Code Council will be publishing the new codes and is currently preparing them for print. Once they are published, they may be purchased at the City Store. Absolutely not. The Department will continue to review and recommend changes to the codes and the City Council will continue to be the body where the codes are revised. Given the City's unique, high-density environment, modifications of national codes will likely be necessary and the new codes will require a review every three years.

A - Local Law 11/98 (amending Local Law 10/80) requires one periodic inspection every five years of building facades on buildings higher than 6 stories. An owner must retain a professional to inspect the façade and submit a report to the Department of Buildings about its condition. NYC Local Law 26 states that all office/commercial buildings in NYC 75 feet or taller must have photoluminescent signage on doors leading to exits as well as photoluminescent way-finding markings in all stairwells.
