No, the purchase of goods or services for related projects must be aggregated whenever practicable. No contract is to be divided for the purpose of avoiding the requirement to obtain formal bids. Rules are being developed to provide guidance in making aggregation decisions.

Competitive contracting is an alternative method of soliciting offers through Requests for Proposals (RFPs) versus Requests for Bids. This method of solicitation may be more appropriate when purchasing specialized goods or services with characteristics that cannot easily be described using standard specifications, for example, the length, width, color, or type of material.

Bids for goods and non-professional services are awarded to the lowest responsive and responsible bidder(s) meeting specifications or to the bidder(s) who received the highest best value ranking. RFP award recommendations are based on other criteria in addition to price. The procurement document will specify the method of award.

The Personnel Systems Reform Act of 2002 became effective in July 1, 2005. General Administration adopted rules around the competitive contracting process (see WAC 236-51 Competitive Contracting), completed a Competitive Contracting Manual, and has made available process training for agency staff that would be making decisions on competitive contracting and those representing fiscal and contracting leads as well as those responsible for developing CC procedure.
