Applications for service are available at the local child support agency in your county of residence. Applications are also available on-line. Child-only cases are those cases in which there is no adult in the assistance unit. In some of these cases, there is no parent living with the child, and the caregiver is not legally responsible for his or her care (i.e. kinship care cases). In other cases, a parent is living with the child, but is ineligible for benefits for some reason.

The California Department of Child Support was established by the Legislature in 1999 to consolidate various child support services that were spread among assorted state agencies.

The Child Support Enforcement Agency may be contacted at (808) 933-8802 between the hours of 9:00 a.m. to 3:00 p.m., Monday through Friday, excluding state and federal holidays. The Hilo Family Support Division can be contacted at (808) 961-8375 and the Kona Family Support Division may be contacted at (808) 324-7117 between 7:45 a.m. and 4:30 p.m., Monday through Friday, excluding state and federal holidays.

Child support is defined by law as the ongoing monetary expenditures and payments necessary to cover a child’s living and medical expenses. Both parents have a legal duty to provide financial support for their children. The court may order either or both parents to make ongoing payments to cover a child’s living and medical expenses.

The majority of the Child Support Division's incoming cases do not have established paternity or child support orders. These cases take longer to process than cases with established paternity and child support orders. Private child support collection agencies and county domestic relations offices generally handle only cases with established paternity and existing child support orders.

Child support case information is confidential and not open to the public. Court files may be public record.

Answer: If you are on public assistance, your Department of Human Services (DHS) caseworker can assist you with establishing paternity and/or starting a child support case. If you do not have a DHS caseworker you may contact the Office of Child Support at (866) 540-0008 for additional information on starting a child support case.

The Family Protection Department (FPD) is your first option and has authority to investigate the reported case. The Family Protection Department is a division of the Public Security Directorate that deals with sensitive issues related to domestic violence and child abuse. Its role is to investigate, prevent and reduce child abuse, sexual abuse and domestic violence utilizing a victim-centered and human rights based approach.

If the obligee no longer wants the services of the Office of Child Support Enforcement(OCSE), he/she can send a written, notarized request to the Office of Child Support Enforcement(OCSE) requesting that his/her case be closed. This only means that the Office of Child Support Enforcement(OCSE) will no longer be collecting support from you. The case is placed on an "inactive" status and can be reopened at any time in the future.

The parents must give the court their most recent tax returns. They must file pay stubs and tell what they earn and spend. The court will usually ask for proof of the expenses, such as for food, rent, clothing, medical costs, child care, and education. The court will listen to all of the evidence from both parents. It will then decide how much the parent who does not have custody has to pay for child support.

One important piece of information is the non-custodial parent's social security number. Other items would include place of employment, home and work address, date of birth and any prior court order information. If you are not receiving CALWorks, your most recent employment information would also be required.

Upon a parent's request, the Department of Child Support Services provides (either in person or by mail) an application packet for completion and return to the department. If a parent is receiving public assistance, the Department of Child Support Services will automatically open a case once we receive notice from the Human Resources Agency.
