Overtime is to be paid on any hours worked in excess of 40 per week. The minimum overtime rate is now $10.50 per hour - based on 1? times the minimum wage of $7.00 per hour. The minimum overtime rate will increase to $11.25 effective October 1, 2007, and to $12.00 effective April 1, 2008.

Overtime must be paid at time and one-half the "regular hourly rate" for every hour over an employee works over 40 hours (or the applicable threshold) in a workweek. (For employees whose normal pay is not an "hourly" rate, their regular rate requires converting pay to an hourly equivalent.) If you only earned commissions, without any guaranteed salary, you are probably entitled to overtime. Your overtime rate, which is called the "regular rate," is the total amount that you earn during a pay period divided by the total number of hours that you worked. Thus, if you earned $2,500 in a two week pay period and worked 55 hours the first week and 59 hours the second week, your regular rate is $2,500 divided by 114 hours, or $21.92.

In certain situations, employees can legally be paid less then time-and-a-half for overtime hours. If an employee who is eligible for overtime receives commission as part of his compensation, his overtime pay only needs to include one-half the hourly amount he receives for commission (though his base pay, if he receives any, should still be paid at time-and-a-half).

Yes, if it is a nondiscretionary bonus. A nondiscretionary bonus is included in determining the regular rate of pay for computing overtime when it is based upon hours worked, production or proficiency. Discretionary bonuses or sums paid as gifts at a holiday or other special occasions, such as a reward for good service, which are not measured by or dependent upon hours worked, production or efficiency, are not included for purposes of determining the regular rate of pay.

Overtime is usually based on more than 40 hours of actual work per week. Benefit hours are separate and should be shown as separate in the payroll records. For example, if you actually worked 36 hours in a workweek and had 8 hours off, paid for a holiday, you are NOT entitled to overtime. Although salary agreements are not covered directly under Vermont law, an employer is required to pay the minimum wage, unless the position is exempt as a bona fide executive, administrative, professional.

Unless specifically exempted, employees must receive overtime pay for hours worked in excess of 40 in a workweek at a rate of 1 and 1/2 their regular rates of pay. Exempt (Monthly) employees are not paid overtime. Non Exempt (Biweekly) employees are paid time and a half. The hours need to be entered on a timesheet. The hours need to be included in the Total Number of hours. If sick/annual leave are taken on the same week as overtime is worked, the employee will only be paid their regular rate of pay not time and a half. Oracle charges $300 for each additional 60 minute set of music beyond the contracted hours. The decision to extend the performance does not have to be made until the very end of the contracted period, at which point you simply ask the band to stay and play some more. We book overtime in 1/2 hour increments. The band typically only books one performance a day, so overtime is never a problem. We'll play for as long as the guests are still partying!
