The Housing Act defines certain tenancy categories that are excluded: Tenancies granted by a resident landlord i.e. a landlord who lives in the same property as the tenant The tenancies listed above are known as 'common law' or 'contractual' tenancies and not assured shorthold tenancies.
Can an assured shorthold tenancy be for less than six months?

If the tenancy agreement or the section 20 notice gave a term of less than six months, even if this was only by one day, then the tenancy could not be an assured shorthold tenancy.
