There is no ordinance that directly deals with property owners' rights in this situation. It is recommended that the property owners try to work out a mutually beneficial solution between them. Normally, a drainage swale can be created on the property between the homes to direct the drainage to the street or backyard and away from structures.

Report this situation to your State Lead Agency. They will assess the situation and may conduct an on-site inspection.

The property owner is responsible for maintenance of private drainage channels, including keeping the drainage channel free of trash, debris, excessive vegetation, and other obstacles that would pollute, contaminate, or retard the flow of water through the drainage channel. In addition, the owner shall maintain existing privately owned structures adjacent to the drainage channel. No. It is a violation of the storm water ordinance to release contaminates into the storm water.

Report your issue to the city's one-call center by calling (904) 630-CITY (2489). A code enforcement officer will then investigate and determine what action needs to be taken.

You can send a certified letter, return receipt requested, to your neighbor, informing him that you'll prosecute him for trespass if he doesn't stop. Send us a copy of the letter. If the neighbor subsequently trespasses, call us and we will send a Deputy to investigate. Alternatively, you may want to contact Chester Valley Community Mediation Service. They offer a free and often successful service for resolving disputes without resort to the courts.

Simply talking to your neighbor about the problem often motivates them to control their weeds. According to the State of Utah Noxious Weed Act and Cache County Weed Policy, each landowner is responsible for the control of noxious weeds on his/her property. The Cache County Weed Department has legal jurisdiction over the control of noxious weeds only. The weed department may cite negligent landowners for their noxious weed problems if they fail to comply with the law.

Certainly you can stop a person from entering onto your private property, in most circumstances. Before you decide to file a lawsuit, however, perhaps a letter from an attorney to the neighbor may be sufficient. Bankruptcy is used more and more frequently to "get a fresh-start". It is, however, a drastic step and should only be used as a last resort. Don't enter bankruptcy unless you have tried Consumer Credit Counseling and that route is not satisfactory.

Stroud Township Ordinance 7-2000 declares certain nuisances as illegal and prohibited. Included are: storing and accumulating garbage and rubbage. Also, keeping unused machinery, equipment, appliances, and items such as scrap metal, glass, industrial waste, and unregistered, uninsured vehicles where they can be seen from a public road, street, lane or alley maintained by the township or state.

It depends upon where the drainage problem is on your property. If it is on the side of your lot, it is a building issue. Drainage easements are usually platted with subdivisions, however they may also be granted individually. All plats and easements must be recorded with the Douglas County Register of Deeds. The City also keeps digital records of drainage easements.

City Code specifically prohibits any obstruction in a drainage easement. Obstructions include man-made barriers such as fences, sheds, firewood and debris, and natural barriers such as trees and brush. If the City determines that a barrier is in fact an obstruction, a violation notice will be issued with instructions to remove the barrier. Drainage easements are platted to provide a path for stormwater runoff, either on the ground or in a buried system.

Drainage easements must be keep clear of all obstacles in order to properly carry the run-off from storms. Flower and vegetable gardens are generally allowed as long as they do not have landscape timbers or other border material. Building, fences, new trees, playground equipment such as swing sets, and similar items that would impede the flow of water or trap debris must not be placed in a drainage easement.

Responsibility lies with the property owner, often the property line is the center of a ditch in which case each adjacent property owner is responsible for their half. If there is underground stormwater infrastructure (pipes) that carries “public” water, the City is responsible unless the system was damaged by the property owner.

The City will perform repairs or corrections to damaged or deficient curbs that cause drainage problems in the street. The timing of any repair project will depend on whether it qualifies for repair under the drainage repair policy and availability of funding. The primary goal of any repairs performed by the City is to mitigate any hazards created by flooding in the street. Refer to Drainage Repair Program for more details.

Even through the actual drain is not on you property, it does drain the storm runoff water from your property.

While it may not reduce the actual value, a cluttered landscape can detract from the positive aspects of your home. Review your local laws, which should be on file at the public library, county law library or City Hall. A typical "junk vehicle" ordinance, for example, requires any disabled car to either be enclosed or placed behind a fence. And most cities prohibit parking any vehicle on a city street too long. It also may be worthwhile to check into local zoning ordinances.
