There are parcels of land in Ontario where landowners may own the surface rights but do not own the mineral rights in, on or below their land. The Ontario Mining Act provides a statutory right to stake mining claims on Crown mineral rights and to conduct assessment work on the mining claims even if the surface rights are privately owned.

When a grant is issued finalizing a patent, the Commonwealth conveys title to all facets of the property, including surface and underground. There are no exclusions retained by state government for timber or minerals such as coal, oil or gas.

Surface rights refer to any right of land that is not mining rights..You are the Deeded property owner and have the legal right to walk & enjoy the surface of the property. You can build or construct a dwelling on the surface of the property.

Surface water is water found over the land surface in streams, ponds, marshes, lakes or other fresh (not salty) sources. Ground water is water occurring in the zone of saturation in an aquifer or soil. Other than the location, one of the primary differences between surface and ground water is that ground water moves much slower than surface water.

The only way to be sure is to check your title commitment or the deed to your property. It is safe to assume that you own the rights if it is not mentioned as an exception on either the deed or title policy. You would have been given a copy of your title commitment at closing or you can order a copy of your deed from the county clerks office.  Generally speaking, the operator that you sign with will check your title and make sure that you own the rights that they are trying to buy.

Chances are, the mineral rights are owned by the Government or by other entities. Information concerning purchasing the rights can be obtained by calling the County in which the property is located.

Court cases are not filed with the Office of the Kentucky Secretary of State.

You will receive any and all title that the Treasurer obtains via their tax foreclosure through a quit-claim deed. If the owner of the surface rights to the property also owned the mineral rights, those will become part of your title interest. However this will be subject to the rights of any outstanding leaseholders of oil, gas, mineral or storage rights.
