San Jose code enforcement is done through the Santa Clara County Animal Control. A formal request for disciplinary action to be taken against another owner by the HOA should be made in writing and contain specific information regarding the offence, such as time and date and whether Animal Control was contacted and responded.

The first action you should take is to speak with your neighbor. You may be able to resolve the problem by discussing it with your neighbor. Your neighbor may not be aware that their dogs' barking is disturbing you. Dogs often bark when their owners are not home. If for some reason you are unable to resolve the problem by speaking with your neighbor, you should contact the Ombudsman's Office at (803) 929-6000 and file a complaint.

Per FLCA Guidelines, barking dogs must be brought inside.  If this isn't happening, usually the best approach is to discuss the problem with your neighbor.  If that doesn't work, call the FLCA Site Manager or write a letter to FLCA (contact information).  The Site Manager and/or Board will work with you to decide what action is necessary.

Your local police department or the sheriff's department handles barking complaints because they are a violation of the noise nuisance ordinance. If the officer determines that the dog is barking because of a situation of abuse, neglect, or cruelty, they will call us for assistance. Many cases of continual barking can be resolved. We recommend the dog's guardian contact our Behavior & Training department for a consultation.

If speaking to your neighbor does not solve the problem, contact Animal Control (209-984-1338) and inform them of the problem. It’s best to have another household in your area corroborate the dates and times of the barking.

Animal noise complaints can be reported during normal business hours (Monday to Sunday 8:30 a.m. to 7:00 p.m.) by calling 416-338-PAWS(7297). As part of our investigation, we will make sure the owner is in compliance with the City of Toronto Municipal Code, Chapter 349 (PDF file size 95KB) The Municipal Code requires an owner to provide adequate and appropriate care for their animals. However the code does not require an owner to allow their dog to sleep inside the house.

Dog lovers say that a house is not a home without a dog, which is often justified for the loyalty and devotions dog demonstrates to its master. Dogs are naturally territorial and curious, that makes them the perfect pet for those who want to protect their properties from burglars and other intruders. Barking is a natural behavior for all dogs. Among the several ways dogs show their emotion, barking is the most useful.

It is recommended that you first kindly inform the neighbor of your concern and request they correct the problem. If that fails, Keller’s code includes a provision for public nuisance including any animal that “makes or creates an unreasonable disturbance to the neighbors or the occupants of adjacent premises or persons living in the vicinity thereof. This includes, but is not limited to, animals making or creating noises by howling, barking, bawling, or otherwise.

We must witness the dog barking or running loose. If you have a complaint, call while the action is in progress, not after the dog has been tied up or has stopped barking.

It is always recommended to speak with the neighbor first, to advise them of the concern about the barking. If it persists, there is a complaint process you must go through. Three neighbors complaints are needed before action can be taken. Question 14: I have a five-year old male Shepherd that acts aggressively toward other dogs. He’s trained, but just doesn’t like other dogs. Question 16: When my dog grabs something, i.e., socks, underwear, etc., it won’t let me take the item out of its mouth.

Owners of dogs can be issued a violation notice with a $25.00 fine. Second or subsequent offenses for excessive barking of their dog incur a $50.00 fine. Some irresponsible dog owners deliberately place their dogs outside neglecting to bring them promptly back in. These owners then leave for the day being unaware that their pets are barking and annoying their neighbors.

A barking dog complaint is one of the most time consuming and intense investigations Animal Control does. It takes time and help from the complainant to end this problem, some complaints take one (1) week to sometimes six (6) months every complaint is different in some way.

Call Animal Services with an address and an officer will speak with the owner. After hours call 972.539.0525
