Unless the Judge has excused your appearance, you are required to appear at each and every court date. If you do not appear, the judge may issue a warrant for your immediate arrest. If an emergency requires you to miss your upcoming court date, you may write a letter to the Judge explaining your situation (send a copy to the District Attorney's office). The Judge may consider your note when your case is called, and may adjourn your case to another day and not issue a warrant.

A criminal court date can be looked up when a defendant's name or docket number is given. (Ask for the Criminal Department)

If you have your court docket number, you can find your court date online. If you do not have a docket number, you can contact the Court Clerk's Office at (316) 268-4611. Please be patient, we receive hundreds of calls each day.

You will have to return to court to ask for your final order of protection. The respondent has the right to a hearing. You may see a different Judge from the one you saw the first time. The Judge you see on the next court date is the Judge likely to decide your case. If the respondent does not come to court: You will be asked to show the Judge that the respondent was properly served.

We have found most Courts do offer an extension or grace period for students who have not completed their traffic school requirement by the original Court assigned Due Date. You are responsible for contacting your Court to ask for an extension. We recommend you complete the course even if you have not received an extension. Note: San Diego County does offer extensions, but typically charge an additional estimated $30-$35 for a 30 day extension.

Generally, no. Such requests should be submitted to the court in writing. You should note that the other party to the case has the right to object to a change in the court date.

If you are the defendant, the judge may enter a judgment against you even if you are not present or the judge may continue the case. If you cannot be in court for some reason, you should immediately notify your attorney. If you do not have an attorney, you should file a motion to continue the case with the Clerk of Superior Court. If you are a petitioner in Family Court, your case will probably be thrown out and any temporary order of protection you had will be gone on that day. If you are a respondent in Family Court, the case can be done without you there (provided the petitioner gave you notice of the case) and an order of protection can be issued. As a respondent or defendant, a warrant may be issued for your arrest in either a Family Court or a Criminal Court if you don't show up.

If you are to appear in court concerning court costs only, the Non Support Minute Clerk of the Clerk's office may continue your case to another date. All others matters must go through Support Enforcement Services. You can reach them at (225) 686-2837.

If you and the other party both agree that you would like to postpone your court date in order to give you time to mediate, we can have you sign a request, which we will send to the court, asking for a continuance (postponement to a later date). If you wish to change your court date for any other reason, you will need to contact the clerk of the small claims court in which your case was filed. The clerk can tell you how to proceed.
