If you were not immediately charged with a crime, that doesn’t mean charges cannot be filed later, after an investigation. Depending on the case, after a complaint is filed, the Court will mail you a Notice to Appear, if they have your current address. If the Court cannot locate a current address for you, an arrest warrant will be issued in your name.

You must appear before the judge on your original court date to obtain a continuance. If you have an attorney, your attorney can file a motion requesting a continuance on your case. Yes. From Magistrate Court either party may take an appeal by filing an appeal in the Magistrate Court within 7 days of the judgment. The case will then restart in State or Superior Court (technically, it is an appeal; but, for all intents and purposes, its a new case.) If the case originated in the State Court, an appeal may only be taken to the Georgia Court of Appeals, if the Notice of Appeal is filed in the State Court (or Superior Court, as the case may be) within 7 days of the judgment.

This is completely dependant on the court system and their court schedule. The Sheriff's Office has little or no control over court appearances. Everyone in custody by 6:00 AM Mon-Fri is booked and the paperwork delivered to Court Administration to be included on the daily jail calendar, however, special circumstances in the courts can arise. By law, new arrests fall under either the 48 or 36 hour rules.

Yes, but you must go to the court indicated on your ticket prior to your court date, or write to the court to request an extension prior to your court date.

If the individual is eligible for pre-arraignment release or needs to pay fines, the correctional staff should be contacted (441-7256/7257) to determine the amount necessary for the individual to be released. The money should then be taken to the Intake and Detention Facility. The money will be placed on the inmate's account and a receipt will be issued. Once the money is received, the release process will begin.

Yes. There is at least one appearance, although not technically in "court", that is required whether under Chapter 7 or 13. It is an initial meeting held about 30 days after filing. The appointed Trustee presides over this meeting; it is not attended by the Judge, and it is designed to permit creditors and interested persons to ask questions concerning the Debtor's assets or financial affairs.

If someone is booked into the Jail on new charges or warrants (with the exception of municipal warrants for which you should contact the municipality to learn court information), they will normally go to court between 3:30 p.m. and 4:30 p.m. the following business day. If they are booked in on a warrant Friday or during the weekend, they will normally go to court Monday morning between 9:00 a.m. and 10:00 a.m.

If "Court Appearance Required" is checked on the Complaint and Summons, you must appear in court at the time and place indicated, even if you wish to plead guilty. For misdemeanor charges, usually the answer is "Yes." Florida law prohibits the settlement of a Felony charge unless the client is present in Court. However, Misdemeanor charges, such as most DUIs, may be settled without requiring your personal appearance. This is referred to as a “Plea in Absentia” and requires the approval of the Court. This is a common procedure for our out-of-area clients who were arrested while in the area on vacation or for work.

If an exam center is testing both in the morning and afternoon, and there is room available, you will be scheduled to take both exams. However, if the exam center only has one session, you will be scheduled to take the exam for the application that was received and entered first into the State Personnel Department's automated filing system. Also, if a written exam is only being given once, that exam is given priority over exams given continuously.
